These Terms of Use ("Terms") supplement the Australian Olympic Committee's ("AOC") Terms and Conditions and Privacy Policy for the website at www.olympics.com.au and apply to the BK Zone Website ("Website"). This Website is owned and operated by the AOC (ARBN 052 258 241 Registered Number A0004778J). To the extent that there is any inconsistency between the AOC's Terms and Conditions and Privacy Policy for www.olympics.com.au and these Terms, these Terms shall prevail.
If you are simply viewing the Website and not contributing any content to it ("Visitor"), then your access to the Website is governed by the AOC's Terms and Conditions and Privacy Policy for the website at www.olympics.com.au. If you intend to contribute content to the Website ("Contributor") you must agree to these supplementary Terms before doing so.
These Terms set out the legally binding terms for the submission of content to the Website. Please read these Terms carefully. By clicking "I Agree" on the button below, you signify your agreement to these Terms, which constitute a binding legal agreement. If you do not agree to these Terms, then you are not permitted to submit content for the Website and should not attempt to do so.
The AOC reserves the right, at its sole discretion, to change, modify or otherwise alter these Terms at any time. Such change or modification shall become effective immediately upon the posting thereof.
Eligibility
NOTICE TO MINORS: This Website is designed to encourage the participation of children, generally between the age of 5-12 years. However, if you are below the age of 18 ("Minor") you must have a parent or guardian (together referred to here as a "Guardian") read and agree these Terms. A Minor is not permitted to agree to these Terms with the AOC and should not purport or attempt to do so.
GUARDIANS (INCLUDING PARENTS): A Contributor must be of at least 18 years of age to submit content for posting on this Website. If a Minor wishes to submit content to this Website they may only do so if a Guardian submits the content on the Minor's behalf and the Guardian thereby becomes the Contributor and the party agreeing to these Terms.
Guardians will be responsible for their children’s use of the Website and adherence to these Terms.

Jurisdiction
These Terms are governed and are to be construed by the laws applicable in the State of New South Wales. Any dispute concerning these Terms and all claims arising out of or in connection with access to the Website and the materials published therein are to be submitted to the courts of New South Wales. If any provision of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms which will continue in full force and effect.
User Generated Content
The Website allows you to submit material such as text, software, images (including photographs), audio and video, including links to that material ("Content") that may be accessed and viewed by others, including the internet audience in general. By submitting Content you represent and warrant that you have rights to and are legally entitled to submit such Content on the internet, or warrant that the owner of the of such rights has authorised you to submit such Content on the internet.
You are responsible for the Content that you submit to the Website, and any material or information that you transmit to other users of the Website and for your interactions with such other users.
Use of Content
You can upload your Content for publication on the Website using the email submission facility provided. The AOC will select submitted Content to be posted on the Website at its discretion and modify it into a version suitable for viewing on the Website. You acknowledge and agree that the AOC reserves the right (but is under no obligation) to do one or all of the following at their sole discretion: (i) monitor the submission of posted Content; (ii) alter, remove, or refuse to post Content, and/or (iii) disclose any Content through the Website.
In submitting Content to the AOC, you grant (or warrant that the owner of such rights has authorised you to grant) to the AOC a perpetual, royalty-free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology (now known or hereafter developed or devised) worldwide. (a) meet the requirements of broadcasting authorities; (b) ensure the Content meets any legal or classification requirements or to avoid any breach of law; or (c) use the Content for the AOC's commercial purposes.
In addition, you warrant that all so-called "moral rights" and other rights recognized throughout the world in those materials have been waived.
You acknowledge that the AOC may allow users to view, listen to, reproduce, download and otherwise deal in the Content. You acknowledge that the AOC may not be able to prevent unauthorised use of your Content, and you accept that, to the extent permitted by law, the AOC is not liable for the ways in which users of the Website elect to use your Content.
By using the Website you understand and agree that you may be exposed to Content posted by other Contributors that may be offensive, indecent or objectionable. The AOC will use reasonable efforts to remove any such Content from the Website should you notify the AOC of it, but the AOC is not under any obligation to do so.
Under the Broadcasting Services Act 1992 you have a right to make a complaint to the Australian Media and Communications Authority ("ACMA") about certain prohibited content or potential prohibited content which, in summary, is internet content that falls within the classifications RC ('refused classification'), X18+ or R18+ for content other than eligible electronic publications, or internet content that falls within the classifications RC, Category 2 Restricted or Category 1 Restricted for eligible electronic publications. This Website contains content owned and controlled by the AOC. The AOC content, including text and images, is protected by copyright. Users of this Website may use the AOC content for information purposes only. Any commercial exploitation of the AOC content is prohibited. The Boxing Kangaroo logo is a registered trade mark and must not be used without the written permission of the AOC.
Personal Information
The Privacy Policy that governs the collection and use of your personal information can be accessed at [insert link]. The AOC operates according to the requirements of the Privacy Act 1988 (Cth) and all relevant privacy legislation.
The personally identifiable information collected from Contributors (and Minors if applicable) includes a first name and surname, email address, date of birth, school (if applicable) and State or Territory ("Personal Information"). Submission of a photo is optional. If you are submitting Content on behalf of a Minor, both your Personal Information and the Personal Information of the Minor must be provided. The only Personal Information which will be disclosed on the Website will be the Contributor's or the Minor's (and in virtually all cases it will be the Minor's) first name, age, and State or Territory to distinguish the Content from other Contributor's Content.
All Personal Information will be securely stored by the AOC and not distributed to any third party. The AOC will not keep any Personal Information obtained beyond the time it is needed. The AOC will not use Personal Information in ways that are materially different from the ones described above without also providing notification to the Contributor of such practices and obtaining consent for any materially different uses .
The AOC reserves the right to co-operate fully with any law enforcement authority in any jurisdiction in respect of a lawful direction or request and reserves the right to comply with any applicable law or regulation, legal process or lawful governmental (or governmental agency) request to disclose any Content or Personal Information or the identity or other information about anyone posting materials.
The AOC is not liable for breaches of any relevant Privacy legislation resulting from your own dealings with users of the Website on or through the Website.

Warranties and Indemnification
By submitting Content to this Website, you: (a) represent and warrant that the Content shall not contain any defamatory, obscene, illegal, viral, threatening or abusive materials and shall not infringe any intellectual property right or any other right of any person or entity and shall not breach any law; (b) signify your agreement to save the AOC, and their officers, directors, shareholders, employees, agents and any related entities from any and all damages, legal actions or causes of action that may now or hereinafter arise as a result of your use of the website and your breach of these Terms and/or any representations and warranties regarding the Content you submit.
